The EAA applies to B2C businesses in specific sectors: e-commerce/online shops, banking services, telecommunications, e-books, ticketing systems, and passenger transport. Pure B2B companies are exempt. Micro-enterprises (under 10 employees AND under β¬2M annual revenue) are exempt for services β but not for physical products like smartphones or computers.
If you have fewer than 10 employees and your annual revenue is under β¬2 million, you qualify as a micro-enterprise and are exempt from the EAA for services (e.g., online shop, website). Note: If you sell physical products covered by the law (hardware, devices), the obligation still applies.
